ABC Detector Underground Imaging Systems DISTANCE SALES CONTRACT

This contract has been drawn up based on the obligation to conclude a contract for online sales in accordance with the Regulation on Distance Contracts Implementation Procedures and Principles published in the Official Gazette dated 13.06.2003 and numbered 25137, and is as follows in articles.

ARTICLE 1 - SUBJECT

The subject of this contract covers the rights and obligations of the parties in accordance with the provisions of the Law No. 4077 on the Protection of Consumers - Regulation on the Implementation Principles and Procedures of Distance Contracts, regarding the sale and delivery of the product sold by the SELLER to the BUYER, whose qualifications and sales price are specified below. .

ARTICLE 2.2 - BUYER INFORMATION

The person who becomes a member of the www.abcdedektor.com.tr shopping site as a customer. The address and contact information used when becoming a member are taken as basis.

ARTICLE 3- SUBJECT OF THE CONTRACT:

The subject of this contract is the Law No. 4077 on the Protection of Consumers and Distance Distance Services, regarding the sale and delivery of goods/services that the Buyer orders electronically from the seller's website www.abcdedektor.com.tr, that have the qualifications mentioned in the contract and whose sales price is specified in the contract. It is the determination of the rights and obligations of the parties in accordance with the provisions of the Regulation on Contracts Implementation Principles and Procedures. Buyer, basic characteristics of the goods/services subject to sale, sales price, payment method, delivery conditions, etc. He accepts and declares that he is aware of all preliminary information regarding the goods/services subject to sale and the right of withdrawal, that he confirms this preliminary information electronically and then orders the goods/services, in accordance with the provisions of this contract. The preliminary information and invoice on the payment page of www.abcdedektor.com.tr are integral parts of this contract.

ARTICLE 4 - GENERAL PROVISIONS

4.1- BUYER declares that he has read and informed all preliminary information regarding the basic characteristics of the product or products subject to the contract, sales price and payment method and delivery specified in Article 3, and has given the necessary confirmation electronically.

4.2- The product or products subject to the contract are delivered to the BUYER or the person/organization at the address indicated within the period explained in the preliminary information, depending on the distance of the BUYER's residence for each product, provided that it does not exceed the legal 30-day period. This period can be extended for a maximum of 10 days provided that the BUYER is notified in advance.

4.3- If the product subject to the contract is to be delivered to a person/organization other than the BUYER, abcdedektor.com.tr cannot be held responsible if the person/organization to be delivered does not accept the delivery.

4.4– abcdedektor.com.tr is responsible for the delivery of the product subject to the contract in a sound, complete manner, in accordance with the qualifications specified in the order and with warranty documents and user manuals, if any.

4.5- For the delivery of the product subject to the contract, the signed copy of this contract must be delivered to abcdedektor.com.tr and the price must be paid with the payment method preferred by the BUYER. If the product price is not paid for any reason or is canceled in bank records, abcdedektor.com.tr is deemed to be free from the obligation to deliver the product.

4.6- After the delivery of the product, if the relevant bank or financial institution does not pay the price of the product to abcdedektor.com.tr due to the unfair or unlawful use of the BUYER's credit card by unauthorized persons, which is not due to the BUYER's fault, the BUYER will not deliver the product to him/her. The product must be sent to abcdedektor.com.tr within 3 days, provided that it has been delivered. In this case, shipping costs belong to the BUYER.

4.7- If Abcdedektor.com.tr cannot deliver the product subject to the contract within the deadline due to force majeure or extraordinary circumstances such as adverse weather conditions that prevent transportation or interruption of transportation, it is obliged to notify the BUYER of the situation. In this case, the BUYER may exercise one of the rights to cancel the order, replace the product subject to the contract with a comparable product, if any, and/or postpone the delivery period until the hindering situation disappears. If the BUYER cancels the order, the amount paid will be paid in cash and in lump sum within 15 business days.

4.8- Defective or defective products, whether sold with a warranty certificate or not, can be sent to abcdedektor.com.tr for the necessary repairs within the warranty conditions.

You can send defective products free of charge with Aras Cargo, in the name of our official company name "ABC Detector Underground Imaging Systems". For shipments made with other cargo companies, the cost belongs to the customer. Shipments made with companies other than Aras Kargo, with buyer payment, will definitely be delivered by our company. By paying attention to this issue, you will not pay shipping costs twice.

4.9- Communication and marketing of the SELLER via letter, e-mail, SMS, phone call and other means through the address, e-mail address, landline and mobile phone lines and other contact information specified by the BUYER in the site registration form or updated by him later. has the right to reach the BUYER for notification and other purposes. By accepting this contract, the BUYER accepts and declares that the SELLER may engage in the above-mentioned communication activities towards him/her.

4.10- This contract becomes valid after the acceptance is confirmed electronically by the BUYER.

ARTICLE 5 - RIGHT OF WITHDRAWAL

The BUYER has the right to withdraw, provided that the cargo package and box are not opened within 14 (fourteen) days from the delivery of the product subject to the contract to him or the person or organization at the address indicated.

In order to exercise the right of withdrawal, the SELLER must be notified by e-mail or telephone at 0212 472 22 20 within this period and the product must not be used and its resellability must not be lost within the framework of the provisions of the relevant article. If this right is exercised, it is mandatory to return the original invoice for the goods/services delivered to the third party or the Buyer. The goods/service fee will be refunded to the Buyer within 14 days following the receipt of the notice regarding the right of withdrawal, and the goods/service will be refunded within 20 (twenty) days. If the original invoice is not sent, VAT and other legal obligations, if any, cannot be refunded to the Buyer. The shipping cost of the product returned due to the right of withdrawal is borne by the BUYER.

The right of withdrawal cannot be used for goods produced in accordance with the user's special requests and demands or personalized by making changes or additions.

ARTICLE 6 - EVIDENCE CONTRACT AND COMPETENT COURT

SELLER records (including records on magnetic media such as computer - voice recordings) constitute conclusive evidence in resolving any disputes that may arise from this Agreement and/or its implementation.

Istanbul Central Courts and Enforcement Offices are authorized for disputes arising from this agreement.

ARTICLE 7 - CONFIRMATION OF THE CONTRACT

BUYER certifies that he/she has read all the conditions and explanations written in this contract and in the order-contract preliminary information form, which forms an integral part of it, and that he/she is aware of the basic characteristics of the products subject to sale, sales price, payment method, delivery conditions, etc. that he/she is informed in advance about all the preliminary information regarding the product subject to sale and the right of withdrawal, that the preliminary information can be seen and confirmed electronically at abcdedektor.com.tr, as well as being sent to the e-mail registered in the system, so that all these can be confirmed electronically, and the product can be ordered and confirmed. declares that he/she accepts the provisions of this agreement.
